Terms of Service
ShotSpin, Inc., d/b/a ShotSpin AI (“ShotSpin,” “we,” “us,” or “our”) provides the ShotSpin mobile app and related services.
1. Eligibility
You must be at least 13 years old to create or use an account unless ShotSpin expressly allows otherwise in writing. By using the service, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms of Service.
2. Your Account
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for activity that occurs through your account.
- You must provide accurate information and keep it reasonably current.
3. The Service
ShotSpin provides tools to record, upload, store, review, and share video and related content in connection with sports performance and coaching workflows. Features may change over time, and we may add, remove, suspend, or modify functionality at any time.
4. Your Content
You retain ownership of content you submit, upload, record, or share through the service (“Your Content”). You grant ShotSpin a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, transmit, and display Your Content solely as necessary to operate, improve, secure, and provide the service.
5. Sharing and Review Features
If you choose to use sharing features for coaching and review, you instruct us to make the selected content available in accordance with the relevant workflow. You are responsible for ensuring you have the rights and authority to upload and share the content.
6. Acceptable Use
You may not:
- Upload, store, or share content that is illegal, infringing, sexually exploitative, harassing, hateful, threatening, or otherwise objectionable.
- Upload content you do not have the right to use or share.
- Engage in abusive, harassing, or threatening behavior towards coaches or other users.
- Use the service to exploit, endanger, or harm minors.
- Attempt to access accounts, data, or systems without authorization.
- Interfere with the operation, security, or integrity of the service.
- Use the service in a way that violates these Terms of Service or any related policy, including our Acceptable Use policy.
7. Suspension, Removal, and Termination
We may suspend or terminate your access, remove content, disable sharing features for coaches or related relationships, or take other action if we believe you violated these Terms of Service, created risk for users, or exposed ShotSpin to legal or operational harm.
8. Feedback
If you provide feedback, ideas, or suggestions, you grant ShotSpin the right to use them without restriction or compensation to you.
9. Disclaimers
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, ShotSpin disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
ShotSpin is not a medical, coaching, officiating, or legal service. Any observations, summaries, or other outputs are informational only.
10. Limitation of Liability
To the maximum extent permitted by law, ShotSpin and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or use.
To the maximum extent permitted by law, the aggregate liability of ShotSpin arising out of or relating to the service or these Terms of Service will not exceed the greater of (a) the amount you paid to ShotSpin for the service in the 12 months before the event giving rise to the claim, or (b) USD $100.
11. Governing Law
These Terms of Service are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except to the extent otherwise required by applicable law.
12. Changes
We may update these Terms of Service from time to time. Continued use of the service after updated Terms of Service become effective constitutes acceptance of the revised Terms of Service.
